Terms of Service

XCASHEW is a B2B digital marketplace and trade operating system for cashewnut trade in East Africa. The platform is owned and operated by CHIMBONETWORK GROUP. XCASHEW provides tools including a marketplace, AI matching, contract management, port tracking, and communications infrastructure for exporters, buyers, transporters, and related trade participants.

You must be at least 18 years old and have the legal authority to enter binding commercial agreements on behalf of yourself or your organisation. By registering, you represent that all information you provide is accurate and that you have obtained all necessary licenses and permits required to trade cashewnuts or conduct your stated business activities.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify XCASHEW immediately at info@xcashew.com of any unauthorised use of your account. XCASHEW reserves the right to suspend or terminate accounts that violate these terms or are used for fraudulent purposes.

Exporters and sellers agree that: (a) all product listings are accurate and represent goods they have the right to sell; (b) listed prices are in the stated currency and inclusive of stated terms; (c) quality grades and certifications claimed are supported by verifiable documentation; (d) they will honour transactions conducted through the platform in good faith. XCASHEW reserves the right to remove listings that violate these requirements.

XCASHEW facilitates transactions but is not a party to contracts between buyers and sellers. Payment processing is handled through authorised third-party processors. XCASHEW is not liable for disputes arising from the quality, quantity, or delivery of goods. All disputes between trading parties must be resolved directly between those parties, with XCASHEW providing documentation support where available.

E-contracts generated on the XCASHEW platform are intended as commercially binding instruments between the signing parties. XCASHEW provides the contract infrastructure but is not a party to any such contract. Parties are responsible for ensuring contracts meet applicable legal requirements in their respective jurisdictions. PDF copies of signed contracts are stored for a minimum of 7 years.

Users may not: post false or misleading product information; use the platform for money laundering or fraudulent transactions; attempt to circumvent the platform's security systems; scrape, copy or redistribute platform data without written permission; use the platform to conduct transactions in sanctioned goods or with sanctioned parties; or impersonate other users or platform staff.

All platform software, design, content, and data belong to CHIMBONETWORK GROUP or its licensors. Users retain ownership of their own data and listings. By submitting content to XCASHEW, you grant CHIMBONETWORK GROUP a non-exclusive licence to display, process and transmit that content for platform operations.

XCASHEW and CHIMBONETWORK GROUP are not liable for: any loss of trade, revenue or profit arising from use of the platform; disputes between trading parties; errors in third-party data including vessel positions, port schedules, or market prices; or system downtime. Our maximum liability for any claim is limited to the platform subscription fees paid by you in the three months preceding the claim.

These terms are governed by the laws of the United Republic of Tanzania. Any disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Tanzania. For international disputes, parties may elect arbitration under the Tanzania Institute of Arbitrators rules.

CHIMBONETWORK GROUP may update these terms at any time. Registered users will be notified of material changes by email. Continued use of the platform after notification constitutes acceptance of the updated terms.
